TERMS & CONDITIONS

  1. Digital Tax Free provides a service and associated services or similar services whereby we gather information from shoppers (called customers hereinafter) not residing in the area where the product is bought in order to process that information to allow the customer to obtain an export refund (VAT or equivalent tax paid at the point of sale).
  2. We ask for personal information because it is necessary in order to make an export refund. We may share information for legal and regulatory reasons with our group companies, the retailer, government departments, tax and customs authorities and/or any required third party in order to make your refund.
  3. Your privacy rights as an individual are explained on our website www.digitaltaxfree.com and include your right to request a copy of information we hold about you and to have inaccuracies corrected.
  4. You will comply with all regulations applicable to the service and as described by us.
  5. The ability to obtain an export refund is subject to Customs & Excise (or its equivalent in the country of export) approval and the customer is solely responsible for obtaining such export approval. Digital Tax Free is not liable for the approval or stamping/signing of documents by Customs or any other authorities. We are not liable if documentation is lost, if applicable it is the customer’s responsibility to provide proof of delivery of such documentation should any dispute arise.
  6. The customer must claim eligibility to use the Retail Export Scheme. There are heavy penalties for false declaration. You confirm your details are correct and you must comply with each jurisdiction’s particular rules (all applicable local laws and regulations in the country, where the goods are bought). We may require additional information to support the VAT refund claim in certain circumstances. Where we suspect that a fraud or attempted fraud is being perpetrated, we reserve the right not to refund.
  7. In some jurisdictions, the customer acquires the goods from us. Where this is the case, this will be clear on the face of the VAT return form issued to the customer. You agree to a) direct any complaint or issue with the goods to the retailer (the retailer’s complaint and return policies will apply to the goods) and b) not to take any action or in any way hold us liable for any loss or damage, whether direct or indirect, due to the defective nature of the goods.
  8. For providing the Tax Free service, we charge the customer a processing fee for each tax free form (transaction). This processing fee varies depending on the amount you have spent. By using this service and returning your tax free form/s to Digital Tax Free, you accept and expressly authorize that a service charge is deducted from the Value Added Tax (VAT) amount refundable.
  9. Digital Tax Free cannot refund on store sales receipts alone, we always require the fully completed and customs stamped tax free form.
  10. It is the obligation of the customer to return the stamped tax free form and the original shop receipt back to Digital Tax Free and at their own cost (Digital Tax Free provides return envelopes in the shop). We are not liable if documentation (return envelope or any other) is lost, if applicable it is the customer’s responsibility to provide proof of delivery of such documentation should any dispute arise.
  11. The original shop receipt is the receipt handed over with the tax free form at the point of sale and when buying the goods. We cannot refund based on copy or re-print of receipt following the legal requirements of goods export in private travel. The retailer can issue a copy for warranty purposes. However, the original receipt must be attached to the tax free form.
  12. The right to receive a refund and our documentation cannot be assigned to another tax free service provider.
  13. Goods must be personally exported within 3 months from the end of the month of sale and from the country where the goods have been bought. If you bought the goods in an EU country, then you must proceed with export in the last country before leaving the EU. When exported and customs stamped, tax free forms are valid for three years form date of sale. In some jurisdictions, these periods may be shorter or longer; you are responsible for complying with these timelines.
  14. Digital Tax Free offers various ways of obtaining your refund. Credit card refunds to Mastercard, VISA and American Express. Bank transfers to IBAN bank accounts and in Schengen area only. Where cash refunds are made these are subject to a cash service fee.
  15. Additional fees arise for processing refunds through bank networks or in case of digital export validation services. In such cases these fees will be passed on to the customer by way of a deduction from the refund amount. Such fees are: transfer fee 1 Euro (credit card and IBAN bank transfer), American Express credit card fee 1,7% of refund amount, digital export validation service fee at Vienna Airport 1 Euro, non-digital processing fee (cross border) 2 Euros.
  16. Digital Tax Free operates a Foreign Exchange Policy for its customers when processing certain refunds:
    1. Where possible, Credit Card refunds will be processed in the customers local currency.
    2. For a refund in a different currency than the currency in which the purchase occurred, the following is applied:
      1. Cash refund desks may apply their own conversion rates when converting from the refund currency to the currency of your choice. Please always ask for details.
      2. The current ‘we sell’ rates of a recognized European Retail Bank plus a markup of between 4-6%.
  17. We endeavor to make your refund as soon as possible; however, we are not liable if a delay occurs.
  18. A refund will not be made where a retailer who has issued a form has not complied with contractual obligations to Digital Tax Free.
  19. The retailer who issues the Tax Free form is the debtor of the VAT to the customer. Digital Tax Free is only responsible for the operational processing of the refund. If the retailer goes bankrupt, Digital Tax Free can no longer pay out the refund. In this case you must address your claim directly to the retailer and the competent court or insolvency administrator.
  20. Digital Tax Free will make the refund based on the information provided by the customer on the Tax Free form. It is helpful if the handwritten information provided is easy to read. If information cannot be read, we might not be able to make the refund and/or contact the customer.
  21. Registered customers using the Digital Tax Free app must provide all relevant and required information directly in the app. Digital Tax Free will always process the refund based on the data provided in the app. It is the sole responsibility of the customer to provide the information in full. Digital Tax Free is not liable if refund is made to the wrong account when using the customer provided information. It is the customer’s responsibility to provide proof the refund has not been received should any dispute arise. If no information on the method of refund is provided, the refund cannot be processed.
  22. The Customer hereby agrees to be contacted by Digital Tax Free for the following purposes:
    1. Phone number confirmation, in the form of OTP SMS, WhatsApp or Email message.
    2. Information or request on Customer transactions in the form of SMS, WhatsApp, Email or In-App message.
  23. Digital Tax Free is entitled to amend and update these General Terms and Conditions at any time.
